 April 16, 2011

Speaker: Kenneth S. Direktor, Esq., from the law firm of Becker & Poliakoff.

Subject:  Board Member Certification Class

Location: Comfort Inn

Note:  New Florida Statutes subsection 718.112(2)(d)3b, which became effective July 1, 2010, requires that new condominium board members complete a certification within 90 days of their election or appointment that they have read the association's documents and written policies and will work to uphold them to the best of their ability and will faithfully discharge their fiduciary responsibility to association members.  But when you have read them, what does all of this mean and what are your real responsibilities as a new board member?  What in the world is a "fiduciary responsibility"?

Fortunately you need not be left dangling in the wind.  The new law also provides an alternative.  That is, instead of the certification, a new board member may submit a certificate that he or she has satisfactorily completed an educational course administered by the Division of Florida Condominiums, Timeshares, and Mobile Homes.  This is such a course.
